terms and conditions


PLEASE READ ALL THESE TERMS AND CONDITIONS BEFORE BUYING WITH US. In particular, our terms relating to delivery of faulty goods (see 23 below), cancellation of your order (see 26 below) and our returns policy (see 27 below). Note we do not deliver outside the UK.

We are legally allowed to accept your order and thereby have an enforceable agreement without further reference to you. It is important therefore, that you read these terms and conditions to make sure you are protected and not signing up to something you will not be happy with. If you are not sure about anything, just email us at hello@arttalkgallery.co.uk before you place an Order and we will see how we can help.

APPLICATION

1.     These Terms and Conditions will apply to the purchase of the goods by you and FoodTalk Group Limited (‘us’ or ‘we’) which is trading in this respect as ArtTalk Gallery. You can find all our company details at www.arttalkgallery.co.uk. on the 'about us' page.  

2.     These are the Terms on which we sell all Goods to you. By ordering any of the Goods, you agree to be bound by these Terms and Conditions.


INTERPRETATION

3.     Contract means the legally-binding agreement between you and us for the sale and purchase of the Goods;

4.     Delivery means the point at which our delivery agent delivers the Goods at the Delivery Location specified by you (see 24 below);

5.     Delivery Location means your premises or other location where the Goods are to be supplied, as set out in the Order;

6.     Goods means any goods that we supply to you, of the number and description as set out in the Order;

7.     Order means your order for the Goods from us as set out in the Customer’s order during the purchase process.


GOODS

8.     The description of the Goods is as set out in our website. If there is a defect, scratches to frames, discolouration due to age etc, these will be described by us and included in consideration of the sale price. Any description is for illustrative purposes only and there may be discrepancies in colour or size from the actual Goods. More detailed condition reports can be obtained by us by emailing hello@arttalkgallery.co.uk.


BASIS OF SALE

9.     The description of the Goods in our website does not constitute a contractual offer to sell the Goods.

10. When an Order has been made, we can reject it for any reason, although we will try to tell you the reason without delay, we are not obliged to.

11. A Contract will be formed for the Goods ordered, only when we have sent you an email saying that the Order has been accepted.

12. No variation of the Contract, whether about description of the Goods, price or otherwise, can be made after it has been entered into unless the variation is agreed by both you and us in writing.


PRICE AND PAYMENT

13. The price of the Goods and any additional delivery or other charges for the Goods, and the total price of them and the charges, is that set out in our price list current at the date we accepted the Order or such other price as we may agree with you in writing.

14. Prices include VAT if applicable, at the legal UK rate at the time of the Order.

15. Payment for Goods are in advance of delivery. You must pay by submitting your credit or debit card details with your Order and we can take payment immediately before delivery of the Goods. We may arrange a bank transfer for certain goods by mutual agreement.

DELIVERY

16. We will endeavour to deliver the Goods to the Delivery Location within 5 working days (see www.arttalkgallery.co.uk/delivery for full details), but this cannot be guaranteed.

17. In any case, regardless of events beyond our control, if we do not deliver the Goods within 15 working days, you can treat the Contract as at an end.

18. If you treat the Contract at an end, we will promptly return all payments made under the Contract.

19. If you were entitled to treat the Contract at an end and your costs have been reimbursed, but in the meantime the Goods have been delivered, you must return them or allow us to collect them from you and we will pay the costs of this.

20. We do not deliver to addresses outside England and Wales, Scotland, Northern Ireland, the Isle of Man and Channel Islands.

21. You agree we may deliver the Goods in instalments if we suffer a shortage of stock or other genuine and fair reason, subject to the above provisions and provided you are not liable for extra charges.

22. If you (or your nominee) fail, through no fault of ours, to take delivery of the Goods at the Delivery Location you have specified, we may charge the reasonable costs of storing and redelivering them if this is applicable.

23. The Goods will become your responsibility from the completion of delivery. You must examine the Goods immediately. If they are damaged or faulty when you receive them you must notify us within 24 hours, giving us photographic evidence of the damaged/faulty item and the damaged packaging via email at hello@arttalkgallery.co.uk . If we agree that the damage was by us or the delivery agent, we will collect the item and replace it completely free of charge if applicable or refund the cost including delivery and return costs. If the item is salvageable we may agree a discount with you by mutual agreement.

 

RISK AND TITLE

24. Risk of damage to, or loss of, the Goods will pass to you when the Goods are delivered to you.

25. You do not own the Goods until we have received payment in full.

 

CANCELLATION

26. You can cancel your Order by emailing us at hello@arttalkgallery.co.uk within 2 hours of purchasing the Goods online. You can do this without giving us a reason and without incurring any liability. We will reimburse your full payment amount promptly.

 

RETURNS

27. We do not accept returns after the Goods have been delivered to the Delivery Location unless they have been damaged or are faulty (see 23 above), or you can prove they do not meet in conformity (see 28 below) at the point of Delivery. 

 

CONFORMITY

28. We have a legal duty to supply the Goods in conformity with the Contract and will not have conformed if they are not of satisfactory quality, do not conform to their description or are not reasonably fit for the purpose for which you buy the Goods.


GOVERNING LAW, JURISDICTION AND COMPLAINTS

29. The Contract (including any non-contractual matters) is governed by the law of England and Wales.

30. Disputes can be submitted to the jurisdiction of the courts of England and Wales or, where the Customer lives in Scotland or Northern Ireland, in the courts of respectively Scotland or Northern Ireland.

31. We aim to absolutely delight all our customers with our customer service and with our products, however if there is a complaint, please contact us directly at hello@arttalkgallery.co.uk. We will aim to respond with an appropriate solution within 5 working days.
